1. License and Agreement Information
The following copyright agreement, license, and terms ("COPYRIGHT TERMS") apply to all products ("PRODUCTS"), both premium (Paid) and free products, offered on our website ("https://echosoundworks.com").
Products bound by these copyright terms may contain a copy of this license and agreement in the form of a PDF file inside the product download folder. The current license posted on the Echo Sound Works website supersedes any preceding license. If you purchased a product that contains an older license, you still have the ability to use your purchased products in your music, both commercially and non-commercially. Depending on the products you purchased, some elements of the copyright agreement may be updated to reflect our current product offerings.
By accessing, purchasing, downloading, or using our products, you agree that you have read, understood, and agree to be bound to the following copyright terms.
If you are not eligible, do not agree to the following copyright terms, or did not purchase or download our products through our website, you do not have our permission to use our products for commercial or even non-commercial purposes.
2. Product Type and Content Definitions
Due to the varied nature of your products, we now categorize various licensing purposes and restrictions with the content(s) of our products into the following 6 categories:
1.) PRESETS - Refers to any sounds created as an extension of a software VST or synthesizer, including but not limited, to Xfer Serum, Native Instruments Massive, Arturia Pigments, Sonic Academy ANA2 and others. Their file types include but are not limited to ".FXP", ".FXB", ".SNDPR".
2.) SAMPLES - Refers to any audio files in a .WAV or .AIFF format. These can be either one shot samples like drum one shots, synth one shots, etc., or looped based samples like drum loops, guitar loops, etc.
3.) MIDI FILES - Refers to any files with a .MID extension. These are MIDI files that can be loaded into any DAW and are usually organized ass as Melodies, Bass Lines, Hi Hat Loops, Chord Progressions and more.
4.) CONSTRUCTION KITS - Is a term used to describe a combination of Samples and MIDI files in a pre-organized into partial song or beat in a self contained folder in the end product.
5.) PROJECT FILES - Refers to our Digital Audio Workstation sessions. Their file types include but are not limited to ".FLP", ".ALS", & ".LOGICX".
6.) PLUGINS - Refers to any of our VST/AU/AAX plugins.
Within each of our products, we separate the content (If applicable) into folders. Meaning you will typically see a folder called "PRESETS" or "SAMPLES" or "MIDI FILES" etc.
3. Terms of use (Royalty Free License)
All material contained within any Echo Sound Works download is the sole intellectual property and creation of Echo Sound Works. The sale (whether free or paid) of any Presets, Samples, Midi Files, Construction Kits, and Project Files or variation thereof, is not a transfer of ownership.
The Presets, Samples, Midi Files, Construction Kits, and Project Files are licensed to you, the User, in accordance with the below User License. User has been granted one (1) non transferable license:
1.) PRESETS - 100% Royalty Free. User can use any Preset(s) in either commercial or non commercial audio productions without consent from Echo Sound Works. This includes streaming platforms, TV and Film, Video games etc.
2.) SAMPLES - 100% Royalty Free. User can use any Sample(s) in either commercial or non commercial audio productions without consent from Echo Sound Works. This includes streaming platforms, TV and Film, Video games etc.
3.) MIDI FILES - 100% Royalty Free. User can use any MIDI File(s) in either commercial or non commercial audio productions without consent from Echo Sound Works. This includes streaming platforms, TV and Film, Video games etc.
4.) CONSTRUCTION KITS - Limited Royalty Free License - Our Construction Kits are royalty free if the User agrees to the following conditions:
i.) Full Demo Looping Restriction - User agrees to not loop construction kit full demo files (these are often used in our demo videos on YouTube) and release as original compositions as just the looped demos. The full construction kit demos are for educational purpose only.
ii.) White Listing Echo Sound Works YouTube Account - If User uses a melodic loop from a construction kit, and posts that song, track, beat, or composition on YouTube, User agrees to white list the Echo Sound Works YouTube account. White Listing our account will stop YouTube's Content ID from placing a claim against our video showcasing the product. Here is a link about how to White List an account.
iii.) The individual Samples, Loops, and MIDI Files contained in a construction are all 100% Royalty Free. As such, User is welcome to use construction kits in their own commercial releases if User changes and makes some element(s) unique to their own composition.
5.) PROJECT FILES - Limited Royalty Free License - The PROJECT FILES contained within our products cannot be looped and exported and released as an "original" track. This is similar to our license regarding Construction Kit Demo Songs. User is free to use the Project Templates as starting off points in making unique "original" songs or beats or compositions. All samples, loops, MIDI Files, and Presets contained in a Project File are royalty free.
6.) PLUGINS - 100% Royalty Free. Are plugins and the sounds you create using them can be used in either commercial or non commercial productions without consent from Echo Sound Works.
4. Copyright License Restrictions
Only the original buyer of our products have the legal right to use the contained PRESETS, SAMPLES, MIDI FILES, or CONSTRUCTION KITS within their own "original" musical compositions for commercial purposes.
Any content included in any of our products CANNOT BE USED in the following ways:
1.) Used to create a competitive product - I.E. any other Sample Pack, Soundset, or Plugin.
2.) Uploaded to file sharing sites. This is expressly prohibited and if we find instances of this, we will pursue any infringement to the fullest extent of the law.
3.) User agrees to not resell, re-compile, lend, lease or repackage any of the sounds
or samples herein in and sell on any other site, either known or unknown. Doing so is strictly prohibited by law.
